1. Introduction & Acceptance of Terms

1.1 Agreement to Terms

By downloading, installing, accessing, or using the Stowly mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

If you are under 18 years of age, your parent or legal guardian must read and agree to these Terms on your behalf. By allowing a minor to use Stowly, the parent or guardian agrees to these Terms and accepts responsibility for the minor's use of the App.

1.2 Definitions

For purposes of these Terms:

• "Stowly," "we," "us," "our": Cask Coded s. r. o., the company that owns and operates the App.
• "User," "you," "your": The person using the App, or the parent/guardian agreeing on behalf of a minor.
• "Services": The Stowly iOS mobile application and all related features, content, and functionality.
• "Content": Stories, images, audio, and other materials generated or created using the App.
• "Diamonds": Virtual currency used to access cloud AI features within the App.
• "Free Tier": On-device AI story generation using Apple Intelligence (free, unlimited).
• "Stowly Pro": Premium subscription tier providing access to cloud AI features.

2. Service Description

2.1 Stowly App

Stowly is an AI-powered mobile application that generates personalized bedtime stories for children. Key features include:

• Story generation based on user prompts
• Age-appropriate content (ages 3-12)
• AI narration for listening while reading
• Story customization (topics, length, language)
• Personal story library stored in iCloud

Platform: iOS 26 or later

2.2 Free Tier (On-Device AI)

The Free Tier provides unlimited access to on-device story generation using Apple Intelligence.

Requirements:

• iPhone 15 Pro or newer
• iOS 26 or later
• Apple Intelligence enabled (Settings → Apple Intelligence & Siri)

2.3 Premium Tier ("Stowly Pro")

Stowly Pro is a paid subscription service providing access to cloud AI features.

Pricing:

• Monthly: $4.99/month
• Annual: $49.99/year (17% savings)

3. Account & Authentication

3.1 Sign in with Apple

Cloud features (Stowly Pro) require authentication using Sign in with Apple.

Your Responsibilities:

• You are responsible for maintaining the security of your Apple ID.
• You must be at least 13 years old to create an account (or have parental consent if under 13).
• If you are a parent/guardian creating an account for your child, you are responsible for all account activity.

3.2 Account Termination

Voluntary Termination:

You may request account deletion at any time by emailing studio@caskcoded.com.

Effect of Termination:

• You lose access to Stowly Pro features immediately.
• Unused diamonds are forfeited.
• Stories stored on your device/iCloud remain accessible (we don't control iCloud).

4. Subscription Terms (Stowly Pro)

4.1 Subscription Plans

Monthly Subscription:

• Price: $4.99/month
• Automatically renews every month
• Includes 100 diamonds per month

Annual Subscription:

• Price: $49.99/year
• Automatically renews every year
• Includes 1,200 diamonds per year (17% savings compared to monthly)

4.2 Auto-Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours before the current subscription period ends.

4.3 Diamond Allocation

Monthly Subscription:

• 100 diamonds granted at the start of each billing period
• Unused diamonds expire at the end of the billing period (no rollover)

Annual Subscription:

• 1,200 diamonds granted at the start of the annual period
• Unused diamonds expire at the end of the 12-month period (no rollover)

Welcome Bonus:

• 10 diamonds awarded on first sign-in (one-time only)
• Welcome bonus diamonds do not expire until used

4.4 Refunds

Subscriptions are generally non-refundable except as required by law. All refund requests are subject to Apple's refund policy. Request refunds via: Apple App Store → Report a Problem or contact Apple Support.

4.5 Cancellation

How to Cancel:

• Go to App Store Settings → [Your Name] → Subscriptions
• Select Stowly Pro subscription
• Tap "Cancel Subscription"

Effect of Cancellation:

• Access to Stowly Pro continues until the end of the current billing period.
• After expiration, you revert to Free Tier (on-device AI only).
• No refund for unused days in the current billing period.

5. Diamond Virtual Currency

5.1 Definition

Diamonds (💎) are virtual currency used to access cloud AI features within Stowly Pro.

5.2 Spending Diamonds

Diamonds are used to access cloud AI features:

Pricing Subject to Change: We reserve the right to adjust diamond costs with advance notice in the App.

5.3 Diamond Expiration

Subscription Diamonds:

Expire at the end of your billing period (no rollover). Example: If you have 50 unused diamonds on the last day of your monthly subscription, they expire when the period ends.

Welcome Bonus Diamonds:

Do not expire until used and remain in your account even if subscription lapses.

5.4 Refunds for Failed Generations

If cloud AI generation fails due to technical issues (server error, API failure, etc.), diamonds are automatically refunded to your account.

6. Acceptable Use Policy

6.1 Permitted Use

You may use Stowly for:

• ✅ Creating personalized stories for personal, non-commercial use
• ✅ Generating age-appropriate prompts suitable for children
• ✅ Storing and sharing stories within your family
• ✅ Printing stories for personal use
• ✅ Using the App in compliance with all applicable laws

6.2 Prohibited Use

You may NOT use Stowly for:

• ❌ Generating illegal, explicit, violent, hateful, or inappropriate content
• ❌ Violating third-party content policies
• ❌ Commercial purposes without prior written permission
• ❌ Reverse engineering or attempting to extract source code
• ❌ Circumventing payment systems or subscription requirements
• ❌ Sharing your subscription credentials with others
• ❌ Using automated tools (bots, scripts, hacks) to manipulate the App

6.3 Content Moderation

Cloud AI features are subject to our AI providers' content policies. Prompts that violate content policies (illegal, explicit, violent, hateful) may be rejected.

7. Intellectual Property

7.1 User-Generated Content Ownership

No License to Us: We do not claim any ownership of your stories. We do not use your stories for marketing, training AI models, or any other purpose without your explicit consent.

7.2 AI-Generated Content

Stories generated by AI are based on your prompts and are considered your content. You may use generated content for personal, non-commercial purposes without restriction.

Commercial Use:

If you wish to use generated content commercially (e.g., publish a book, sell stories), you may need additional licensing from the AI provider. Contact studio@caskcoded.com for guidance.

7.3 Stowly Intellectual Property

All rights, title, and interest in the App, including software code, App design and user interface, Stowly branding (name, logo, trademarks), and App features are owned exclusively by Cask Coded s. r. o.

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal use in accordance with these Terms.

8. Disclaimers & Limitations of Liability

8.1 Service Provided "AS IS"

Stories May Contain Errors:

AI-generated stories may contain factual errors, inaccuracies, inconsistencies, grammatical mistakes, or unexpected content (despite our filters). We do not review, verify, or endorse AI-generated content.

8.2 Limitation of Liability

Maximum Liability: Our total liability to you is limited to the greater of: (1) The amount you paid for Stowly in the last 12 months, or (2) $100 USD.

8.3 Indemnification

You agree to defend, indemnify, and hold harmless Cask Coded s. r. o., its officers, directors, employees, and agents from any claims, damages, liabilities, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or content you generate using the App.

9. Privacy & Data Protection

Your use of Stowly is also governed by our Privacy Policy. By using the App, you consent to the data practices described in the Privacy Policy.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time.

Material Changes:

We will notify you via in-app notification, email (if provided), or updated "Last Updated" date. We will provide at least 30 days' notice before material changes take effect.

Continued Use = Acceptance: Continued use of Stowly after the updated Terms take effect constitutes your acceptance of the changes.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Slovak Republic, without regard to conflict of law principles.

Informal Resolution:

Before filing any legal claim, you agree to contact us at studio@caskcoded.com to attempt informal resolution. We will respond within 30 days and work with you in good faith to resolve the issue.
